The Labour Relations Act stipulates the rights and obligations of both employee and employer.
It provides for inter alia the rights of employees not to be unfairly dismissed or subjected to unfair labour practices.
A dismissal can only be fair if the correct procedures are followed and a code of good practice applied. An employee may be dismissed fairly only for misconduct, incapacity and operational reasons.
